Article 1 - Preamble
Article 2 - Definitions
The following terms used in these General Terms and Conditions of Sale have the following meanings:
- Customer: refers to the natural person who purchases one or more Products on the OLIJO Website for personal, private and non-professional use and who has accepted these General Terms and Conditions of Sale; ;
- Confirmation of availability: e-mail sent to the Customer confirming the availability of the Product and its actual delivery; ;
- Customer Account: refers to the account that users have the option of opening on the Website, in particular for the purpose of purchasing one or more Products, and which contains personal information about the user, as well as information relating to the user's order(s);
- Product(s): shall designate all products offered for sale by on 's Internet Site.
- Website: shall designate the website accessible at https://www.olijo.fr and operated by OLIJO ;
User: refers to any natural person using the Website.
Article 3 - Purpose
These General Terms and Conditions of Sale govern the contractual relationship between the Customer and OLIJO in connection with the sale of the Products displayed on the Website and specify, in particular, the terms and conditions of ordering, payment and delivery.
The Customer is required to read these General Terms and Conditions of Sale carefully before purchasing a Product or Products on the Website. The General Terms and Conditions contain important information about the Customer's rights and obligations.
The fact that the Customer validates the order of a Product or Products on the Website implies full and unreserved acceptance of these General Terms and Conditions of Sale. This is expressly acknowledged by the Customer, in particular by ticking the box provided for this purpose before starting the online ordering procedure.
The General Terms and Conditions of Sale can be accessed at any time on the Website in the «General Terms and Conditions of Sale» tab at the bottom of the page.
Article 4 - Enforceability of the General Terms and Conditions of Sale
These General Terms and Conditions of Sale come into force on the date they are posted online. The version binding on the Customer is the one accepted on the Website when the order is validated.
Each purchase on the Website is governed by the General Terms and Conditions of Sale applicable on the date of the order.
The various versions of the General Terms and Conditions of Sale are archived in paper, PDF and Word format on a secure, off-site server.
OLIJO reserves the right to modify certain provisions hereof at any time. These modifications or adaptations are enforceable against the Customer as soon as they are put online and cannot be applied to orders concluded previously.
Article 5 - Products
The main characteristics of the Products, and in particular the illustrations and indications of dimensions, composition, origin and weight, its use and its suitability for use are presented on the description sheet for each Product and on the Website in dedicated sections.
The Customer is obliged to familiarise himself/herself with these terms and conditions before placing an order, as the choice and purchase of a Product are the sole responsibility of the Customer.
The Products are described as accurately as possible,
photographs are not contractually binding and shall not incur OLIJO's liability

The purchase of a Product on the Website is payable in euros.
Any costs of exchange with the Customer's currency shall be borne exclusively by the Customer. Similarly, if customs duties or other taxes are payable, they will be charged to the Customer.
Delivery of Products is free of charge in Metropolitan France and the European Union. For deliveries outside mainland France and the European Union, we recommend that you contact from OLIJO in order to obtain a quote for delivery costs and any additional taxes.
Article 7 - ORDERING PROCESS
7.1 creating a customer account
Users wishing to order on the Website must open a Customer account, provide the information requested using the form available online and choose a password.
When creating a customer account, the user undertakes to provide accurate information concerning their civil status and contact details, in particular their e-mail and postal addresses, as this information is required for delivery of the Products. The Customer is responsible for updating the information provided, which can be changed by logging into their account.
Similarly, the Customer is solely responsible for the preservation and confidentiality of his/her password.
7.2 ordering stages
Users wishing to purchase one or more Products must follow the steps below on the Website:
1. Select the product(s) you want; ;
Depending on the Product(s) selected, the Customer must :

3. Choose the size of your finger;
4. Choose the colour stones ;
5. Choose the number, shape and position of the ring(s) or the centre, rings and decorations in accordance with the proposals provided on the Site for each Product;
6. Specify the quantity of Product required;
7. Add product to basket ;
8. Confirm the order when all the Products have been added to the basket;
9. Create a customer account if you have not already done so, or log in using your customer account.
10. Choose the desired delivery method (home delivery or collection directly from the showroom in Paris. For all deliveries outside Metropolitan France or the European Union, the Customer must contact OLIJO);
11. Choose your payment method ;
12. Check the order details and correct them if necessary;
13. Confirm acceptance of the General Terms and Conditions of Sale in force on the day the order is placed by ticking the appropriate box;
14. Confirm the order by clicking on the «Order with obligation to pay» button;
15. Confirm payment orders requiring payment.
The Customer shall be solely responsible for its choice of Products and their suitability for its needs and OLIJO shall not be held liable in this respect.
The Customer has the possibility, if he so wishes, prior to any order and for any information, to request from OLIJO a personal appointment as indicated on the Website.
The total or partial inability to use the Products, in particular due to the choice of a finger size that is too small or too large, for example, shall not give rise to any compensation, reimbursement or liability on the part of OLIJO, as the Products are custom-made.
Article 8 - Payment terms
8.1 method of payment
Payment for an order by the Customer is made by bank card. The online payment system is secure and encrypts the transmission of bank details.
8.2 reservation of ownership clause
The Products ordered by the Customer remain the property of OLIJO until the total amount of the order has been paid. This right of ownership allows OLIJO to repossess the Products in the event of non-payment of the total amount due by the Customer.
Article 9 - Order confirmation
Once the order has been placed, OLJJO will send the Customer an e-mail confirming the order, which will include information about the Products ordered, their prices and delivery charges.
In addition, the Customer may go to «My Account», then to «Order History and Details» and click on the order in question to obtain details of the order.
OLIJO reserves the right to refuse or cancel a Customer's order for any legitimate reason, in particular in the following cases:
- incorrect entry of bank details ;
- refusal of payment by the Customer's bank ;
- fraud involving means of payment or any other similar criminal offence by the Customer ;
- non-existent delivery details.
Clause 10 - DELIVERY
10.1 cONTENT OF DELIVERY
The Product(s) ordered are delivered in a case and accompanied by a certificate of authenticity and an invoice guaranteeing the Product(s).
10.2 PLACE AND COST OF DELIVERY
OLIJO delivers the Products free of charge to the Customer in Metropolitan France and in the European Union, to the delivery address provided by the Customer at the time of the order. For deliveries outside Metropolitan France and the European Union, it is recommended to contact de OLIJO to obtain a quote for costs and taxes.
The Customer may also choose to collect the Product(s) ordered directly from the Paris Showroom.
10.3 DELIVERY TIME
The Products will be delivered on the date or within the indicative period indicated to the Customer on the order validation page and, failing this, at the latest within six weeks of validation of the order.
If the Products are not delivered on the date or at the end of the six-week period specified in the Product Data Sheet, the Customer will have the option of cancelling the order if the delay in delivery is not due to a case of force majeure such as the freezing or stoppage of all means of transport or communication, the adoption of an administrative or legislative regulation having a significant impact on the production of the Products, the restriction on the number of visitors or exceptional closure of a category of premises defined by law or decree, pandemics, epidemics, illnesses, inability to travel, power cuts, wars, attacks, riots, government restrictions. Thus, the Customer may, after having enjoined OLIJO by registered letter with acknowledgement of receipt or in writing on a durable medium, to make the delivery within a reasonable additional time, if the latter has not complied within this time, cancel the order.
In case of cancellation of the order, OLIJO will proceed to the reimbursement of the totality of the sums paid, excluding any indemnity, within a period of fourteen days following the cancellation of the order.
10.4 TRANSPORT
All risk of loss or damage to the Product is transferred to the Customer at the time when the Customer or a third party designated by the Customer takes physical possession of the Product.
On receipt of the order, the Customer is required, in the presence of the carrier, to check that the Products delivered conform to the order, to check the condition of the parcel (poor condition, open parcel, missing or damaged products, torn security strip, etc.) and to express any reservations on the delivery note, in handwritten form accompanied by his/her signature.
At the same time, and without prejudice to the applicable legal guarantees, the Customer must send any reservations regarding the lack of conformity of the products existing on the date of delivery as soon as possible by e-mail to contact@olijo.fr.
Article 11 - Legal guarantee of conformity
11.1 implementation of the guarantee
All Products on sale on the Website are covered by the legal guarantee of conformity and the guarantee against hidden defects (resulting from a defect in material, design or manufacture affecting the products and rendering them unfit for use), allowing the Customer to return defective or non-compliant products delivered.
OLIJO shall be liable for any lack of conformity which appears within a period of twenty-four (24) months from the delivery of the goods.
In the event of proven non-conformity, the Customer will have the choice between repairing or replacing the Product, unless the option chosen entails a cost that is clearly disproportionate to the other option, taking into account the value of the Product or the extent of the defect.
If the repair or replacement of the Product is impossible, OLIJO undertakes to reimburse the Customer for the price of the Product in exchange for its return or to offer the Customer a reduction in the price paid and the retention by the Customer of the Product.
This warranty does not cover Products damaged by the Customer as a result of an accident or misuse by the Customer, negligence or lack of maintenance by the Customer, or normal wear and tear of the product. If the Product is damaged by the Customer and not as a result of a manufacturing defect, the cost of returning the Product and repairing it shall be borne by the Customer.

Le Client souhaitant retourner un Produit, dans le cadre de l’exercice de la garantie légale de conformité doit en informer OLIJO en envoyant un courrier électronique à l’adresse suivante : contact@olijo.fr
Article 12 - remise à taille
En cas d’erreur du Client sur la taille du tour de doigt, il bénéficie d’un délai de trente (30) jours à compter de la date de livraison pour demander à OLIJO de procéder à une remise à taille. La remise à taille est d’une taille maximum par rapport à celle demandée lors de la commande.
Cette demande doit être faite par écrit à OLIJO à l’adresse suivante : contact@olijo.fr
Le Client devra indiquer la nouvelle taille demandée (dans la limite d’une taille maximum) et suivre exactement le processus de renvoi indiquer par OLIJO, sachant que les frais de retour sont à la charge du Client.
Si le Client souhaite une remise à taille supérieure à une taille, celle-ci sera à sa charge et lui sera facturée par OLIJO. Avant toute intervention, OLIJO réalisera un devis indiquant au Client la faisabilité et le prix de cette remise à taille.
La demande de retour pour modification du tour de doigt ne sera effective qu’à partir du moment où OLIJO accuse réception par écrit de la demande de retour.
A réception du Produit, OLIJO vérifiera qu’il est en parfait état. Les Produits retournés, abîmés, endommagés ou salis pourront être remis à taille dans les conditions ci-dessus, mais ne seront pas remis en « état neuf ». Tel est le cas notamment des Produits qui présentent des rayures, même discrètes.
Par ailleurs, OLIJO vérifiera que la monture et les pierres, ou tout autre élément constitutif du Produit, sont bien conformes au Produit objet de la commande qui a été envoyée au Client et qu’il n’a fait l’objet d’aucun dommage, modification, ni intervention d’aucune sorte. Si tel était le cas, le Produit ne pourrait être remis à taille.
Article 13 - rétractation
Selon les dispositions légales, le Client dispose d’un délai de quatorze (14) jours pour déclarer qu’il souhaite exercer son droit de rétractation, sans avoir à motiver sa décision. Ce délai court à compter du jour de la réception de la commande par le Client ou un tiers désigné par lui, autre que le transporteur.
Article 14 - droits de propriété intellectuelle
OLIJO est titulaire des droits de propriété intellectuelle ou a acquis les droits lui permettant d’exploiter notamment le Site internet, les marques, dessins, les modèles, les images, les textes, les photos, les logos, les chartes graphiques, les logiciels, les moteurs de recherche etc. présents sur le site internet.
De même OLIJO est titulaire des droits de propriété intellectuelle sur les Produits proposés à la vente sur le Site internet et notamment les dessins, modèles, logos, dénominations représentées.
Les présentes conditions générales de vente n’emportent aucune cession d’aucune sorte des droits de propriété intellectuelle sur tout ou partie des éléments ci-dessus au profit du Client.
Toute reproduction et/ou représentation totale ou partielle d’un de ces éléments sans l’autorisation expresse de OLIJO est interdite et constituerait une contrefaçon.
Article 15 - responsabilité
OLIJO ne saurait être tenue pour responsable de l’inexécution d’une commande en cas de force majeure, du fait d’un tiers ou du fait du Client.
Article 16 - données personnelles
Les informations qui sont demandées sur le Site internet sont nécessaires à la gestion de la commande et notamment à la livraison et à la facturation du Produit.
Les destinataires des données sont les services internes de OLIJO ainsi que le transporteur et/ou le logisticien auquel OLIJO fait appel.
En application de la loi Informatique et libertés, le Client est informé qu’il a un droit de questionnement, d’accès, de modification et de rectification par courrier électronique à l’adresse : contact@olijo.fr et qu’il dispose également d’un droit d’opposition, pour motif légitime. OLIJO conserve les données pour la durée strictement nécessaire à la réalisation de la finalité des traitements.
Article 17 - conservation
OLIJO assure la conservation de l’écrit constatant la commande du Client portant sur un montant supérieur ou égal à cent vingt (120) euros pendant une durée de dix (10) ans à compter de la livraison du Produit ayant fait l’objet de la commande.
Les contrats seront conservés sous format électronique.
Le Client aura accès à tout moment à cet écrit pendant cette même durée en adressant une demande à l’adresse suivante : contact@olijo.fr
Article 18 - nullité
Si une ou plusieurs stipulations des présentes Conditions Générales de vente sont tenues pour non valides ou déclarées comme telles en application d’une loi, d’un règlement ou à la suite d’une décision passée en force de chose jugée d’une juridiction compétente, les autres stipulations garderont toute leur force et leur portée.
Article 19 - loi
Le Contrat est régi par la loi française, tant pour les règles de fond que pour les règles de forme.
Article 20 - médiation
En cas de litige non résolu par une solution amiable et ayant fait l’objet d’une réclamation écrite adressée par un Client à OLIJO, le différend pourra être soumis au médiateur de la consommation dont les coordonnées sont les suivantes :
