Article 1 - Preamble

The https://www.olijo.fr website is published by PDG, SASU, whose registered office is at 29, rue le Marois 75016 Paris, registered with the Paris Trade and Companies Registry under number 830 883 633, whose VAT number is FR07830883633 and whose telephone number is 06 62 40 08 79, hereinafter referred to as "OLIJO" and represented by its President, Priscilla de Gastines.

Article 2 - Definitions

The following terms used in these terms and conditions of sale have the following meanings:

- Customer: refers to the natural person who purchases one or more Products on the OLIJO Website for personal, private and non-professional use, and who has accepted the present General Terms and Conditions of Sale;
- Availability Confirmation: e-mail sent to the Customer confirming the availability of the Product and its effective delivery;
- Customer Account: designates the account that users have the option of opening on the Website, in particular for the purpose of purchasing one or more Products, and which contains personal information concerning the user, as well as information relating to the user's order(s);
- Product(s): designates the products offered for sale by OLIJO on its Website.
- Website: shall designate the website accessible at https://www.olijo.fr and operated by OLIJO;
User: shall designate any natural person using the Website.

Article 3 - Purpose

These General Terms and Conditions of Sale govern the contractual relationship between the Customer and OLIJO in connection with the sale of the Products displayed on the Website and notably specify the conditions of order, payment and delivery.

 

The Customer is required to read these General Terms and Conditions of Sale carefully before purchasing a Product or Products on the Website. The Terms and Conditions contain important information about the Customer's rights and obligations.

 

The fact that the Customer validates the order of a Product or Products on the Website implies full and unreserved acceptance of these General Terms and Conditions of Sale. This is expressly acknowledged by the Customer, in particular by ticking the box provided for this purpose before the online ordering procedure begins.

 

The General Terms and Conditions of Sale can be accessed at any time on the Website in the "General Terms and Conditions of Sale" tab at the bottom of the page.

Article 4 - Enforceability of the General Terms and Conditions of Sale

The present General Terms and Conditions of Sale come into force on the date they are put online. The version opposable to the Customer is that which he has accepted on the Website at the time of validating his order.

 

Each purchase on the Website is governed by the General Terms and Conditions of Sale applicable at the date of the order.

 

The various versions of the General Terms and Conditions of Sale are archived in paper, PDF and Word format on a secure, off-site server.

 

OLIJO reserves the right to modify certain provisions of the present contract at any time. These modifications or adaptations are enforceable against the Customer as soon as they are put online and cannot be applied to orders concluded previously.

Article 5 - Products

The main characteristics of the Products, including illustrations and indications of dimensions, composition, origin, weight, its use and its suitability for use are presented on the description sheet for each Product, as well as on the Website in dedicated sections.

The Customer is obliged to familiarize himself/herself with these terms and conditions before placing an order, as the choice and purchase of a Product are the sole responsibility of the Customer.

 

The Products are described as accurately as possible, photographs are not contractually binding and OLIJO cannot be held responsible responsibility of OLIJO, in particular with regard to the color of the stone chosen by the Customer. Before ordering a ring, the Customer is order a ring with at least one stone larger than 0.40ct, the Customer should contact contact OLIJO directly by e-mail at contact@olijo.fr in order to validate an order order and/or the color of the stone, for example.

 

Product offers are valid as long as they are visible on the Website.

Article 6 - Prices

The prices of the Product(s) are indicated in euros and include all taxes. They take into account the VAT applicable on the day of the order.

 

OLIJO reserves the right to modify the prices displayed on the Website at any time. However, prices are firm and non-revisable to the Customer once the order has been validated.

The purchase of a Product on the Website is payable in euros.

 

Any costs of exchange with the Customer's currency will be borne exclusively by the Customer. Similarly, if customs duties or other taxes are payable, they will be charged to the Customer.

 

Delivery of Products is free of charge in Metropolitan France and the European Union. For deliveries outside Metropolitan France and the European Union, it is recommended to contact OLIJO in order to obtain an estimate of delivery costs and any additional taxes.

Article 7 - ORDERING PROCESS

7.1 creating a customer account

The user wishing to order on the Website must open a Customer account, provide the information requested from the form available online and choose a password. 

 

When creating a customer account, the user undertakes to provide accurate information concerning his/her marital status and contact details, in particular e-mail and postal address, as this information is required for delivery of the Products. The Customer is responsible for updating the information provided, which can be modified by logging into his/her account.

 

Similarly, the Customer is solely responsible for the preservation and confidentiality of his password.

7.2 ordering steps

Users wishing to purchase one or more Products must complete the following steps on the Website:

 

1. Select the desired product(s) ;

 

Depending on the Product(s) selected, the Customer must :

3. Select finger size ;

4. Choose the color stones;

5. Choose the number, shape and position of the ring(s) or the center, rings and decorations in accordance with the proposals provided on the Site for each Product;

6. Specify the quantity of product required;

7. Add product to basket ;

8. Confirm the order when all the desired Products have been added to the basket;

9. Create a customer account if you have not already done so, or log in using your customer account.

10. Choose the desired delivery method (home delivery or collection directly from the showroom in Paris. For deliveries outside mainland France or the European Union, the customer must contact OLIJO);

11. Choose your payment method ;

12. Check order details and correct if necessary;

13. Confirm acceptance of the General Terms and Conditions of Sale in force on the day of the order by ticking the appropriate box;

14. Confirm the order by clicking on the "Order with payment obligation" button;

15. Confirm payment, thus confirming the order with payment obligation.

 

The Customer is solely responsible for its choice of Products and their suitability for its needs, such that OLIJO cannot be held liable in this respect.

 

The Customer has the possibility, if he so wishes, prior to any order and for any information, to request a personalized appointment with OLIJO as indicated on the Website.

 

The total or partial impossibility of using the Products, in particular due to the choice of a finger size that is too small or too large, for example, shall not give rise to any compensation, reimbursement or liability on the part of OLIJO, as the Products are custom-made.

Article 8 - Payment terms

8.1 method of payment

Payment for orders is made by credit card. The online payment system is secure and encrypts the transmission of bank details.

8.2 reservation of ownership

The Products ordered by the Customer remain the property of OLIJO until the total amount of the order has been received. This right of ownership enables OLIJO to repossess the Products in the event of non-payment of the total amount due by the Customer. 

Article 9 - Order confirmation

As soon as the order is placed, OLJJO will send the Customer an e-mail confirming the order, which will include information concerning the Products ordered, their prices and delivery charges.

 

In addition, the customer can go to "My Account", then to "Order History and Details", then click on the order in question to obtain the details.

 

OLIJO reserves the right to refuse or cancel a Customer's order for any legitimate reason, in particular in the following cases:

- incorrect entry of bank details ;

- refusal of payment by the customer's bank;

- fraudulent use of payment instruments or any other similar criminal offence by the Customer ;

- non-existent delivery details.

Article 10 - DELIVERY

10.1 cONTENT OF DELIVERY

The Product(s) ordered are delivered in a case and accompanied by a certificate of authenticity, as well as an invoice which guarantees the Product(s).

10.2 PLACE AND COST OF DELIVERY

OLIJO delivers the Products to the Customer free of charge in Metropolitan France and the European Union, to the delivery address provided by the Customer at the time of ordering. For deliveries outside mainland France and the European Union, it is recommended to contact OLIJO for an estimate of costs and taxes.

 

The Customer may also choose to collect the Product(s) ordered directly from the Paris Showroom.

10.3 DELIVERY TIME

The Products will be delivered on the date or within the indicative time indicated to the Customer on the order validation page and, failing this, at the latest within six weeks of order validation.

 

In the event of failure to deliver on the date or at the end of the six-week period specified in the Product description, the Customer may cancel the order if the delay in delivery is not due to force majeure, such as the freezing or stoppage of all means of transport or communication, the adoption of an administrative or legislative norm having significant consequences on the realization of the Products, the limitation of frequentation or exceptional closure of a category of places defined by law or decree, pandemics, epidemics, diseases, impossibility of displacement, power failures, wars, attacks, riots, governmental restrictions. Thus, the Customer may, after having enjoined OLIJO by registered letter with acknowledgement of receipt or in writing on a durable medium, to make the delivery within a reasonable additional period, if the latter has not complied within this period, cancel the order.

 

If the order is cancelled, OLIJO will reimburse all sums paid, excluding any compensation, within fourteen days of the cancellation of the order.

10.4 TRANSPORT

All risk of loss or damage to the Product is transferred to the Customer when the Customer or a third party designated by the Customer takes physical possession of the Product.

 

On receipt of the order, the Customer is required, in the presence of the carrier, to check the conformity of the Products delivered with the order, to check the condition of the parcel (poor condition, open parcel, missing or damaged products, torn security strip, etc.) and to express any reservations on the delivery note, in handwritten form accompanied by his/her signature.

 

At the same time, and without prejudice to applicable legal warranties, the Customer must address any reservations regarding defects in conformity of the products existing at the date of delivery as soon as possible by e-mail to contact@olijo.fr.

Article 11 - Legal warranty of conformity

11.1 implementation of the warranty

All Products sold on the Website benefit from the legal warranty of conformity and the warranty against hidden defects (resulting from a defect in material, design or manufacture affecting the products and rendering them unfit for use), allowing the Customer to return defective or non-compliant products delivered.

 

OLIJO shall be liable for defects in conformity which appear within twenty-four (24) months of delivery of the goods.

 

In the event of proven non-conformity, the Customer will have the choice between repairing or replacing the Product, unless the option chosen entails a cost that is manifestly disproportionate to the other option, taking into account the value of the Product or the extent of the defect.

 

If repair or replacement of the Product is impossible, OLIJO undertakes to refund the Customer the price of the Product in exchange for its return or to offer the Customer a reduction in the price paid and the retention by the Customer of the Product.

 

This warranty does not cover Products damaged by the Customer as a result of accident or misuse by the Customer, negligence or lack of maintenance by the Customer, or normal wear and tear of the Product. If the Product is damaged by the Customer and not due to a manufacturing defect, the cost of returning the Product for repair will be borne by the Customer.

11.2 return policy

The Customer wishing to return a Product under the legal warranty of conformity must inform OLIJO by sending an e-mail to the following address: contact@olijo.fr

Article 12 - Resizing

In the event of an error on the part of the Customer as to the size of the finger, the Customer shall have a period of thirty (30) days from the date of delivery to ask OLIJO to resize the garment. Resizing is limited to a maximum of one size larger than that requested at the time of order.

 

This request must be made in writing to OLIJO at the following address: contact@olijo.fr

 

The Customer will have to indicate the new size requested (within the limit of a maximum size) and follow exactly the return process indicated by OLIJO, knowing that the return costs are at the Customer's charge.

 

If the Customer requires a resizing larger than one size, this will be at the Customer's expense and will be invoiced by OLIJO. Before any intervention, OLIJO will draw up an estimate indicating to the Customer the feasibility and the price of this resizing.

 

The return request for a change of finger tour shall only be effective once OLIJO has acknowledged receipt of the return request in writing. 

Upon receipt of the Product, OLIJO will check that it is in perfect condition. Products returned, damaged or soiled may be resized under the above conditions, but will not be returned in "new condition". This applies in particular to Products with scratches, even if discreet.

 

In addition, OLIJO will verify that the setting and stones, or any other component of the Product, are in conformity with the Product that was the subject of the order sent to the Customer and that it has not been subject to any damage, modification or intervention of any kind. If this were the case, the Product could not be resized.

Article 13 - Withdrawal

In accordance with legal provisions, the Customer has a period of fourteen (14) days to declare that he wishes to exercise his right of withdrawal, without having to justify his decision. This period runs from the day of receipt of the order by the Customer or a third party designated by the Customer, other than the carrier. 

No right of withdrawal for OLIJO Products All of the Products offered by OLJO on the Website are custom-made to meet the Customer's needs, and for which the Customer chooses the color of the gold, the stones, the shapes of the rings and decorations, the size of the finger, etc., and made to the Customer's specifications. Therefore, in accordance with article L.221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for Products ordered on the OLIJO website.

Article 14 - Intellectual property rights

OLIJO is the owner of the intellectual property rights or has acquired the rights allowing it to exploit in particular the Website, trademarks, designs, models, images, texts, photos, logos, graphic charters, software, search engines, etc. present on the Website.

 

Likewise, OLIJO is the owner of the intellectual property rights over the Products offered for sale on the Website and in particular the designs, models, logos and names represented.

 

The present terms and conditions of sale do not imply any transfer of intellectual property rights of any kind to the Customer for all or part of the above elements.

 

Any reproduction and/or total or partial representation of one of these elements without the express authorization of OLIJO is prohibited and would constitute an infringement.

Article 15 - Liability

OLIJO shall not be held liable for the non-fulfillment of an order in the event of force majeure, the act of a third party or the act of the Customer.

Article 16 - Personal data

The information requested on the Website is necessary for the management of the order and in particular for the delivery and invoicing of the Product.

 

The recipients of the data are OLIJO's internal departments as well as the carrier and/or logistician used by OLIJO.

 

In accordance with the French Data Protection Act, customers are informed that they have the right to question, access, modify and rectify information by sending an e-mail to : contact@olijo.fr and that they also have the right to object, for legitimate reasons. OLIJO keeps data for the time strictly necessary to achieve the purpose of the processing..

Article 17 - Storage

OLIJO shall keep the written record of the Customer's order for an amount for an amount greater than or equal to one hundred and twenty (120) euros for a period of ten (10) years from the delivery of the Product for which the order was placed.

 

Contracts will be kept in electronic format.

Article 18 - Invalidity

If one or more stipulations of these General Terms and Conditions of Sale are held to be invalid or declared as such in application of a law, regulation or following a final decision of a competent court, the other stipulations will retain their full force and scope.

Article 19 - Law

The Contract is governed by French law, both in terms of form and substance.

Article 20 - Mediation

In the event of a dispute which has not been resolved amicably and which has been the subject of a written complaint addressed by a Customer to OLIJO, the dispute may be submitted to the Consumer Mediator whose contact details are as follows:
